Procedure
When, in the course of receiving a material grant award or participating in laboratory research, the college is presented with a Material Transfer Agreement (MTA), the following procedure will be followed:
-
The principal investigator and his or her chair and department head will review the draft MTA and clarify responsibilities, terms, and questions.
-
The department head will submit the MTA to the college鈥檚 special assistant for legal affairs for review and any necessary changes in language, specifically regarding indemnification.
-
After legal review, the department head will submit the MTA to the chief financial officer or his or her designee for review and signature.
-
The science lab coordinator and/or safety compliance officer will review the terms for delivery, storage, and return of materials and will sign the MTA.
-
The faculty member(s) who will be using/working with the material will sign the MTA; distribute copies of the signed MTA to the science lab coordinator, business office, and department head; and submit the signed MTA to the issuing organization(s).
Purpose
鈥淎 Material transfer agreement (MTA) is a contract that governs the transfer of tangible research materials between two organizations, when the recipient intends to use it for his or her own research purposes. The MTA defines the rights of the provider and the recipient with respect to the materials and any derivatives. Biological materials, such as reagents, cell lines, plasmids, and vectors, are the most frequently transferred materials, but MTAs may also be used for other types of materials, such as chemical compounds and even some types of software鈥 (V. Rodriquez, 2008).
